Removal, Shipping Information and Special Terms
These auction terms are subject to the Grafe Auction User Agreement, which governs the overall use of the Grafe Auction website and services. By participating in the auction, you agree to be bound by both the User Agreement and these auction terms.
Inspection and Preview:
- Public Preview: Buyers are encouraged to attend the public preview to inspect the auction items before bidding.
- Buyer's Responsibility: Buyers are responsible for carefully examining the items to ensure they meet their expectations. Participation in the auction signifies acceptance of the items' condition.
Removal Location and Schedule:
- Pick-Up Location: 7434 Olive Blvd, St. Louis, MO, 63130
- Dates and Times: February 19th through February 24th, 9:00 AM to 6:00 PM
- Appointment Mandatory: Book at Grafe Auction Removal Appointments

Payment, Removal, and Shipping:
- Payment Deadline: Noon, the day following the auction. Payment by credit card only.
- Payment Default: If payment is not received by the specified deadline, the buyer will be deemed in default. Upon default, the seller reserves the right to immediately resell or dispose of the unpaid items at their sole discretion, without further notice to the buyer. The buyer's failure to pay by the deadline neither extends the payment timeline nor limits the seller's rights to resell or dispose of the items. In cases of resale, the original buyer will be liable for any damages, calculated as the bid price less the resale price. If the item is disposed of, the original buyer will be liable for the full bid price plus any disposal fees.
Removal Responsibilities:
- Buyer's Responsibility: Disconnecting and removing items. Full payment required before removal.
- Onsite Assistance: Available for a small fee through the onsite removal assistance contact. Note: Onsite team are contractors, not employees of Grafe Auction.
- Shipping and Preparation:
- Shipping Arrangements: The buyer is responsible for arranging the shipping and preparation of items for shipment. Assistance may be available through the onsite removal assistance contact for a small fee.

- Abandonment: Items not removed by the end of the removal period will be resold or disposed of.
- Risk and Liability:
- Risk Transfer: Risk passes to you upon receipt of items at the seller's location.
- Liability Waiver: By participating in the auction, you agree to waive claims against Grafe Auction and its associates related to the auction items. In addition to this waiver, the limitation of liability in Section 12 of the Grafe Auction User Agreement applies to all transactions and use of the website and services.
Warranties and Disclaimers:
- Accuracy and Verification: Information subject to buyer verification.
- No Liability for Errors: Seller and Grafe Auction not liable for listing inaccuracies.
- Item Removal: In accordance with UCC § 2-328(3), the seller reserves the right to remove items from the auction at any time until the auctioneer announces the completion of the sale.
- "As Is" and "Where Is": All items are sold "as is" and "where is," without any express or implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, as outlined in UCC § 2-316(3)(a) and stated in the Grafe Auction User Agreement (Sections 5.5 and 10.2).
- Governing Law: Any disputes arising from the auction shall be governed by the laws of the United States, the State of Minnesota, and the Uniform Commercial Code (UCC), as stated in Section 14.1 of the Grafe Auction User Agreement, without reference to rules governing choice of laws.
